Overcrowding Rules Checker

Find out the overcrowding rules for your rental property and how many people can legally live there.

General information only — not legal advice. Overcrowding assessments depend on specific property and circumstances. The 2-per-bedroom guide is indicative. Last updated: January 2026.

How overcrowding is assessed

The standard guideline across Australia is 2 adults per bedroom. This is a guide, not a hard legal limit — the actual assessment depends on room sizes, floor area per person, and ventilation.

Children under 10 are often treated differently — two children can usually share a bedroom. Single adults in shared houses are generally assessed per bedroom.
